Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Aberdeen Co ("Company," "we," "us," or "our") concerning your access to and use of the Hugo application and website (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Description of Service

Hugo is an AI-powered personal assistant that helps you organize tasks, events, goals, and other aspects of your personal and professional life. The Service includes web, iOS, and Android applications that allow you to interact with our AI assistant through text and voice input.

Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old (or 16 in certain jurisdictions) to create an account and use the Service.

Subscriptions and Payments

Free and Paid Plans

Hugo offers both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans (Hugo Pro and Hugo Power) provide additional features and higher usage limits.

Billing

Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan). Payment is processed through the Apple App Store or Google Play Store. By subscribing, you authorize us to charge your chosen payment method.

Cancellation and Refunds

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period. Refunds are subject to the policies of the Apple App Store or Google Play Store.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our consent
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems to access the Service without permission
• Impersonate any person or entity
• Collect user information without consent

User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. We reserve the right to remove any User Content that violates these Terms.

AI-Generated Content

The Service uses artificial intelligence to generate responses and suggestions. You acknowledge that:

• AI-generated content may not always be accurate, complete, or appropriate
• You should verify important information before relying on it
• AI suggestions are not professional advice (legal, medical, financial, etc.)
• You are responsible for any actions you take based on AI-generated content

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Aberdeen Co and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Hugo" and associated logos are trademarks of Aberdeen Co. You may not use our trademarks without our prior written consent.

Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of such services is at your own risk and subject to their respective terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABERDEEN CO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar issues transmitted through the Service
• Any errors or omissions in any content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Aberdeen Co and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through the app settings. All provisions of these Terms that should reasonably survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
